Terms of Service

1. Introduction

These Terms of Service ("Terms") govern all services provided by Mensura Engineering Surveys ("we", "our", "us") to any client ("you", "your"). By engaging our services, you agree to these Terms.

2. Scope of Work

All services provided will be outlined in a formal quote or proposal. Any additional work requested outside the original scope may incur additional charges and will require written approval.

3. Fees & Payment

Payment terms are strictly [14 days] from the date of invoice unless otherwise agreed.

Late payments may incur a late fee or result in suspension of services.

All pricing is quoted excluding GST unless stated otherwise.

4. Site Access & Conditions

You agree to provide safe and reasonable access to all relevant areas required for Mensura Engineering Surveys to carry out our work. Any delays caused by restricted access, unsafe conditions, or lack of readiness may result in additional charges.

5. Accuracy & Deliverables

Mensura Engineering Surveys takes all reasonable care to ensure data is accurate and suitable for its intended purpose. However, we are not liable for errors resulting from changes made after the survey or from using the data outside of its intended scope.

6. Client Responsibilities

You are responsible for providing all necessary information before commencement of work, including site plans, scope, and contact details. We rely on this information to deliver accurate and timely results.

7. Cancellations & Rescheduling

Due to the nature of construction scheduling, we require a minimum of 3 business days’ notice for any cancellations or rescheduling of booked works.

Short-notice cancellations (less than 3 business days) may incur a fee to cover allocated labour, preparation, or travel costs. We understand delays happen on site, and we’ll always do our best to remain flexible where possible—but consistent communication is key.

8. Intellectual Property

All survey data, drawings, models, and deliverables remain the intellectual property of Mensura Engineering Surveys until full payment has been received. Upon full payment, you are granted a non-exclusive license to use the deliverables for the intended purpose.

9. Confidentiality

Mensura Engineering Surveys will treat all information shared with us as confidential and will not disclose it to any third party without your consent unless required by law.

10. Liability

To the extent permitted by law, Mensura Engineering Surveys is not liable for any indirect or consequential loss arising from the use of our services. Our liability is limited to the re-performance of services or the cost of re-performing those services.

11. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through informal discussion before escalating to formal mediation or legal action.

12. Governing Law

These Terms are governed by the laws of Western Australia. Any disputes arising from these Terms will be handled within its jurisdiction.
